The purpose of Chapter Five of the Canadian Free Trade Agreement (CFTA) is to establish a transparent and efficient framework to ensure fair and open access to government procurement opportunities for all Canadian suppliers. The following highlight key elements of Government Procurement under this Agreement.
Doing Business
Federal, provincial and territorial governments currently advertise tender notices on their own procurement websites or on an electronic tendering system operated by a third party service provider.
Bid Review
In the event of a complaint by a supplier alleging that there has been a breach or failure of a Party’s adherence to the CFTA’s procurement review procedures, a supplier can issue a challenge in accordance with Article 518, paragraphs 5-7.
Covered Procurement Thresholds
In accordance with Annex 504.4 of the Canadian Free Trade Agreement (CFTA), the Secretariat shall notify the Parties of the adjusted covered procurement threshold values no later than November 1 of the year prior to the adjustment taking effect.
Statistics
Parties to the Canadian Free Trade Agreement (CFTA) are required to report annually on the number and aggregate values of their covered procurement contract awards, broken down by procuring entity type as set out in Article 504.3 of the CFTA.
