PANEL SUBMITS REPORT REGARDING A REQUEST FOR SUMMARY DISMISSAL IN THE DISPUTE BETWEEN JULMAC CONTRACTING LIMITED AND THE GOVERNMENT OF NEW BRUNSWICK

A Panel formed under the Canadian Free Trade Agreement (CFTA) issued a Report on a Request for Summary Dismissal of the Proceeding in the Person-to-Government dispute between Julmac Contracting Limited and the Government of New Brunswick. The Report is available on the CFTA website.

Julmac Contracting Limited had requested that Proceedings be initiated against the Government of New Brunswick due to allegations of unfair treatment regarding the procurement of bridge construction and repair services.

The Panel concluded that the Government of New Brunswick did not meet its burden of demonstrating that the requirements for summary dismissal had been met. Therefore, the Panel declined the Government of New Brunswick’s Request for Summary Dismissal in its entirety.

The Panel comprised the following individuals: Debra Steger (Chair), Robert Deane and Drew Tyler.
